Animation Sherpa maintains this website, any courses offered and other linked and related sites (the “Site”) for the use of its customers, vendors, students, and other Site users (“Users”) upon agreement to the following terms. Please read the terms carefully before using the Site. Use of this website indicates acceptance of these “Terms of Use” and forms a binding agreement between you and Animation Sherpa If you do not agree to these terms, do not use this Site.
1. Use of Site
1.1 Animation Sherpa provides various materials, videos, documents, animation rigs, and other information on this and related sites and in courses offered through this site (the “Material”). Animation Sherpa authorizes each User to view the Material for personal and learning purposes. Animation rigs may be downloaded and used for animation learning purposes and non-commercial animation or game projects, provided that Users make no modifications to the Material and Animation Sherpa retain all copyright and other proprietary notices contained in the original Material on any copies of the Material. Users may not modify the Material at this Site in any way or reproduce, share, reverse engineer, or distribute them. Users will keep all Material confidential, and will not sell, auction, loan, rent, give away, describe, summarize, or otherwise reveal the Material or their contents, to any other person or entity. Corporate licenses are not available. Enrollment is on an individual basis and non-transferable. Sharing this Material with your employer is strictly prohibited. Any breach of these Terms of Use automatically terminates your authorized use of the Site.
1.2 A Course (“Course”) constitutes a collection of Material such as video lectures and supporting documentation. Once a user purchases access to a course, said user will maintain access to all Course Material for the life of the site, or until user cancels their account with Animation Sherpa. Courses are sold individually. User access is limited to the specific Course(s) purchased. Animation Sherpa may edit/alter course Material at any time for the purposes of clarification, improvement, or maintaining relevance.
1.3 Animation Sherpa is an online video vault for animation training only. It is not a live classroom format. Therefore, enrollment in Animation Sherpa Courses is not purchasing a one-on-one mentorship. 1.4 Due to the nature of this video class format, there are no refunds.
1.5 The “Space Switching” course focuses exclusively on Autodesk Maya. Many of the principals can be transferred to other animation software, but the specific steps are completed within Maya. Animation Sherpa does not provide a license for Autodesk Maya. Students are expected to obtain their own access to animation software of their choosing.
2. INDEMNIFICATION
User agrees to indemnify and hold Animation Sherpa and employees harmless from any liability, loss or damage they may suffer as a result of claims, demands, costs or judgments against them arising out of the activities to be carried out pursuant to the obligations of this Agreement, including, but not limited to, the use by User (customer) of the results obtained from the activities performed by Animation Sherpa under this Agreement; provided, however, that any such liability, loss or damage resulting from the negligence or willful malfeasance of any employee of Animation Sherpa, is excluded from this Agreement to indemnify and hold harmless.
3. User Warranty
As a User you warrant that you will utilize the Site and Material solely for the purpose of educational and personal use. Site and Material are not to be used for commercial profit.
4. Trademark and Copyright
Animation Sherpa, and certain other brands, trademarks, and service marks are marks of Animation Sherpa and its affiliates. The Material on this Site are copyrighted, and any unauthorized use of any Material on this Site may violate copyright, trademark, and other laws.
5. Hyperlinks
Links to external websites are provided solely as a convenience to you. Animation Sherpa has not reviewed all of these external websites, does not control and is not responsible for any of these sites or their content. If you decide to access any of the external websites linked to this Site, you do so entirely at your own risk.
6. No Warranty
The Material provided at this site are provided “as is” without any warranties of any kind including warranties of merchantability, fitness for a particular purpose, or non-infringement of intellectual property. Animation Sherpa further does not warrant the accuracy and completeness of the Material at this Site. Animation Sherpa may make changes to the Material at this Site, or to the services and prices described in them, at any time without notice. The Material at this Site may be out of date, and Animation Sherpa makes no commitment to update the Material at this Site.
7. Limitation of Liability
In no event will Animation Sherpa, its suppliers, or other third parties mentioned at this Site be liable for any damages whatsoever (including, without limitation, those resulting from lower test scores, interruption of services or inaccurate information) arising out of the use, inability to use, or the results of the use of this Site, any websites liked to this Site, or the Material or information contained at any or all such sites, whether based on warranty, contract, tort or any other legal theory and whether or not advised of the possibility of such damages. If your use of the Material or information from this Site results in the need for servicing, repair or correction of equipment or data, you assume all costs thereof.
8. Applicable Law
The Terms of Use are governed by the laws of the state of Washington, United States. Failure to enforce strict performance of the Terms of Use of Use shall not be construed as a waiver of any provision or right. Animation Sherpa may assign its rights and duties under the Terms of Use without notice to any party at any time.
9. Effective Date and Updates
The Terms are effective as of January 1st, 2020 and are subject to change without notice by Animation Sherpa at any time. Please check for changes regularly. Your use of this Site after such changes constitutes your agreement to such changes.
